This fee expires annually and the adoption date is not on file

This is a Level 2 school facilities fee under California Government Code section 65995.5. It rests on a School Facilities Needs Analysis, and section 65995.6(f) requires that analysis to be updated every year. No adoption date has been established for it, so no expiry can be computed — the effective date of the rate is deliberately not used, because adoption comes first and using it would credit the fee with time it never had.

If the district does not re-adopt, the fee reverts to the Level 1 statutory rate, which is lower. That makes this one of the few refresh risks in this index that runs downward, so the figure here may overstate rather than understate what is owed. Check the district's current schedule before relying on it.

The record

Why it exists

“The purpose of a School Facilities Needs Analysis ('SFNA') is to quantify, for the next five-year period, the impacts of new residential development on the school district's facilities and calculate the permissible Level II and Level III Fees.”

Credits and offsets

“A governing board may offer a reimbursement election to the person subject to the Level III Fee that provides the person with the right to monetary reimbursement of an agreed portion of the difference between the Level III and the Level II Fee to the extent that the District receives funds from state sources for construction of the facilities for which that amount was required, less any amount expended by the district for interim housing.”

How it changes
